General Terms and Conditions
Legal basis for our transport services
§ 1.) Scope of Application
The General Terms and Conditions (GTC) apply to contractual relationships between FlughafenExpress and the client for the transportation of persons in rental car traffic (driving service). Such a contractual relationship begins when FlughafenExpress receives a transportation order by phone, email, SMS, WhatsApp or via the online booking platform. Acceptance does not require a specific form. For airport transfers, the contractual service can be confirmed in writing via WhatsApp, SMS, email or via booking confirmation at the express request of the customer.
§ 2.) Services
Transportation is carried out according to the respective and current service catalog. The customer is responsible for choosing the appropriate services and/or form of transportation. Prices apply as agreed. The basis for negotiation is the current price list of FlughafenExpress.
The client's data is used and stored as the basis for billing. The provisions of the General Data Protection Regulation (GDPR) apply. Transfer to third parties is only permitted with the express consent of the customer.
§ 3.) General Conditions
a) Routes, departure times and departure locations are determined jointly by FlughafenExpress and the customer.
b) The specified pickup time may differ by +/- 15 minutes. If the vehicle is not at the departure location at the agreed pickup time + 15 minutes, the customer is obliged to inform FlughafenExpress at +49 151 405 556 66.
c) If the customer has not made himself known to FlughafenExpress within 1 hour after landing, there is no claim to return transport. The costs are to be borne by the customer.
d) In case of flight delays, the return transport of the customer is secured by FlughafenExpress. We offer you a free waiting time of 60 minutes. For longer waiting times, we charge a flat rate of EUR 10.00 for each started 15 minutes. The maximum waiting time is 120 minutes.
e) If the vehicle is not at the airport at the specified time, or if driver and customer miss each other, FlughafenExpress must be notified via airport information.
f) If the customer has rebooked the return flight himself, there will be no refund of the transfer price. Any additional costs are borne by the customer.
g) If another airport is used, the customer must go to the agreed airport. (Airline provides transportation). FlughafenExpress must be informed immediately about this process.
h) FlughafenExpress waits at the airport specified in the order confirmation.
§ 4.) Liability
a) FlughafenExpress is liable for the proper provision of the contractually agreed transportation service.
b) FlughafenExpress does not assume any additional costs for missing the flight due to force majeure. This includes severe weather, traffic jams, accidents, breakdowns, fault of third parties.
c) FlughafenExpress will bear all additional costs incurred for missing the flight if the cause of the delay lies in its own behavior.
d) The customer is liable for damage to the vehicle caused by the customer. This includes cleaning the vehicle inside and outside, as well as liability for damage to the paint and interior if this was caused intentionally, through gross negligence or as a result of excessive alcohol consumption.
e) The customer and FlughafenExpress must have asserted mutual complaints within 3 days after the service was provided, otherwise they will not be recognized or considered.
§ 5.) Payment
a) Payment for services in passenger transport is due in cash after the service has been provided. Card payment is possible with advance notice and a surcharge of 2€.
b) The price can be paid in advance at any time. The payment conditions printed on the invoice apply. Invoicing is possible for regular customers.
§ 6.) Withdrawal by the Customer
The customer can withdraw from passenger transport by FlughafenExpress at any time. However, the customer is obliged to report the withdrawal to FlughafenExpress as quickly as possible.
As a customer, you can cancel the concluded "transport contract" (booking) without additional costs up to 24 hours before the pickup time agreed upon booking. After that, we charge 90% of the fare.
FlughafenExpress reserves the right to decide at its own discretion whether cancellation fees should be charged within the framework of the guidelines mentioned here or not.
§ 7.) Service and Price Changes
FlughafenExpress is obliged to inform the customer immediately about service and price changes. If necessary, the customer will be offered a free withdrawal.
§ 8.) Severability Clause
Should one or more provisions of these GTC become wholly or partially invalid, this does not affect the validity of the remaining provisions. The invalid provision(s) shall be replaced by one that corresponds to the meaning and purpose of these GTC in factual, legal and economic terms.
§ 9.) Validity of the GTC
The general terms and conditions of FlughafenExpress can be viewed on the website and are accessible to customers at all times. The customer agrees to the General Terms and Conditions of FlughafenExpress upon conclusion of the contract.
§ 10.) Side Agreements
If agreements deviating from these GTC are made, they only apply if they have been agreed in writing. Oral agreements are not permitted.
Important Information
Luggage and Passenger Compartment
The transport of luggage in the passenger compartment is not permitted. Our vehicles provide space for up to 4 people (or 8 with van booking) and corresponding luggage in the trunk.
The risk of injury in emergency braking or an accident increases with every piece of luggage in the passenger compartment. Additionally, luggage can cause damage to the high-quality leather equipment of our vehicles.
Child Seats and Safety
Every passenger needs their own seat and their own seat belt. Transporting children or babies on the lap is not permitted.
We provide appropriate child seats or booster seats free of charge for children. Please specify the age and weight of children when booking.
If you do not provide information about traveling children and we determine before starting the journey that children are supposed to travel without suitable child seats, we will not start the journey and unfortunately have to charge you for the costs of the wasted trip.
